If You Ban Guns in Your Business or Building Know the Consciences

  Concealed carry means businesses must be aware of legal risks of welcoming, banning weapons

 

One aspect many businesses are still considering is the potential of facing a lawsuit. Take the extreme example that a person legally carrying a concealed pistol, walks into a business and accidentally shoots someone.

 

Attorney Daniel Finerty says a store that did not post a sign banning guns, may avoid a lawsuit, because of the way the law was drawn up.

 

"It was clearly written to incentivize businesses to allow weapons," Finerty said.

 

Finerty says those businesses would be protected from the legal argument they should be responsible for injuries, because they chose not to ban weapons.

 

"By contrast, if that business did post, it would not enjoy the same immunity," Finerty said.

 

In the same scenario, a store that does post a "no weapons" sign, could be found legally responsible for any injury that comes from gunplay.

 

The difference is subtle, but the difference in legal fees could be costly.
